With the acceptance and usage of this application, the User agrees, in its name and/or in name of the entity he/she represents, to strictly abide by this T&C. These T&C define a binding agreement (hereinafter “Agreement”) between the User and Place Checkup pertaining to the use of the application.

1. Ads and other information
a. Much like other websites, we collect and use information through ads. Information collected through ads includes your IP address (Internet Protocol), your ISP (Internet Service Provider), the browser you used when visiting our website (such as Internet Explorer, Firefox or others) and/or the average duration of your visit, which pages you visited while browsing our website and other relevant data regarding your navigation.

3. Intended use
a. Place Checkup is an application (hereinafter, Place Checkup or “Application”) intended for businesses (hereinafter “Registered Business”) to share the fulfillment of specific cleaning and maintenance routines (hereinafter, “protective routines”) in order to mitigate the the risk of SARS-CoV-2 virus, and subsequent, COVID-19 infection. In the Application, Registered Business can auto-report having fulfilled the recommended policies in order to minimize risk of contagion.
b. Place Checkup is only intended to be a way for businesses to share in an ethical and responsible way their effort in minimizing the risks of contagion of SARS-CoV-2 virus, and subsequent, COVID-19 infection, not being Infraspeak, S.A. liable for any incorrect or malicious use or reporting.
c. Place Checkup users can use the App to see Registered Businesses in the selected region.
4. Exclusion of liability
a. Infraspeak S.A. does not control or manage the information, products, services or conducts of the Registered Businesses, nor does it represent the actions of said Registered Businesses. As such, Infraspeak, S.A. cannot be responsible for error of any nature, of incorrect data, submitted by these Parties.
b. Registered businesses are legally responsible for any misconduct or erroneous reporting regarding the fulfillment of the protective routines.
c. Infraspeak, S.A. does not audit businesses frequency and completion of the protective routines.
d. Infraspeak, S.A. rejects all and any responsibility for any direct, indirect or consequential damages arising from the use or inability to use Place Checkup, nor does it control or is liable for any illegal, offensive or unethical usage by its Users.
5. Responsibility of the Registered Businesses
a. The Registered Business is the only responsibles for the information shared. Any information or reporting are exclusive responsibility of the Registered Business.
b. Regardless of the defined rules and diligence of Infraspeak, S.A., it is not possible to have an exhaustive control over the contents shared by Registered Businesses and, as such, it is not possible for Infraspeak, S.A. to guarantee the quality, integrity, precision and veracity of those.
c. Infraspeak, S.A. reserves the right to remove from Place Checkup, any information or message which defies the good usage of the application.
6. Privacy and personal information
a. Personal data from the Registered Businesses is indispensable to access and use application and are automatically processed for this purpose
b. In legal terms, it is guaranteed to any Registered Business the right to access, modify and update their personal data, as well as the right to oppose to their usage.
c. The omission or inaccuracy of personal data and other information shared bu the Registered Businesses, is of their own responsibility.
7. Applicable Law and litigation
a. These T&C are governed by the Portuguese Law and, in case of dispute in the interpretation or application of these T&C, the jurisdiction of the District of Porto will be exclusively competent, with express waiver of any other.
